Carlos Rafael – fuskande US-amerikansk fiskeriföretagare

Carlos Rafael är en mycket stor fiskeriföretagare i New Bedford, Massachusetts, USA. Han äger ett fiskhandelsföretag, Carlos Seafood (det finns ett företag i Florida med samma namn, det äger han inte) som exporterar och importerar fisk och fiskprodukter. Dessutom äger han helt eller delvis nästan 50 fiskebåtar samt stora mängder fiskerättigheter för plattfisk och vitfisk (demersalt fiske på bottenlevande fisk).

När det infördes överförbara individuella fiskerättigheter (TFC) i det demersala fisket i Massachusetts år 2010 bestämdes inga regler för hur mycket en enskild person/företag/grupp av företag fick äga. Detta utnyttjade Carlos Rafael och han innehar idag huvuddelen av fiskerättigheterna på bottenlevande fisk i Massachusetts fiskevatten. Hans viktigaste fiske är dock fiske av pilgrimsmussla (scallops).

Under hela sin existens som fiskeriföretagare i Massachusetts har Carlos Rafael använt tveksamma metoder i sitt fiske och detta har lett till ständiga rättsprocesser. Det går att hävd att han köpt sig sin dominerande position i det demersala fisket med olagligt intjänade pengar. I början av 1980-talet häktades han för skattebrott och så fortsatte det:

In the early 1980s, he was thrown in jail for four months and 14 days for federal tax evasion. He operated his then fledgling business through phone calls from the federal pen. Looking back, he admits he filed his taxes incorrectly. Or, more accurately, in his own words: “I had no fucking clue about that fucking shit.”

He was taken to federal court again in the mid-90s. This time he faced charges of price-fixing. He was staring down a lengthy prison term but insisted the matter go to trial. He says he was targeted by others in the industry because he was so successful and ended up spending $1.5 million on his legal defence, which was ultimately successful. He still relishes telling off the federal prosecutor after he got off.

He’s had other legal headaches: he was accused of falsifying documents in order to obtain fishing permits. He has fought federal regulators, sometimes successfully, when they seized a catch illegally or fined his boats without cause. His boats have been cited for fishing for scallops in a closed area. In 2011, he made national headlines when the feds seized an 881-pound tuna that one of his boats had caught. They said it was caught illegally, but Rafael disagrees. He says that single fish could have fetched hundreds of thousands of dollars on the open market. Last year, after the local fire department cited his fleet for fire safety violations along the docks, Rafael threatened to up and move his vessels to Maine or Rhode Island.

Nu är det dags igen. Denna gång är det lite värre än tidigare. Han är misstänkt för omfattande skattebrott, valutasmuggling, illegalt fiske, svarta löneutbetlningar, svarta inkomster, olaglig fiskförsäljning och mycket mer. Tillsammans med honom är en vicesheriff i Bristol County, Antonio M. Freitas, misstänkt för brott. Bland annat har de fångat fisk över kvoterna, landat dem som nåt annat än de verkligen är, i allmänhet arter med lägre värde och sedan sålt dem svart:

The agents requested the meeting, Mullett wrote, so Rafael could detail his system of catching high-value fish, such as dabs, labeling them as lower-value fish, such as haddock, and then selling them for cash to a buyer in New York City – netting $668,000 over one recent six-month period.

”We call them something else. It’s simple,” Rafael allegedly said. ”We’ve been doing it for over 30 years.”

According to Mullett, Rafael described how his business worked around visits by federal and environmental regulators.

”You will never get away with all the fish. What I’m saying is without the feds being there or the green police being there. But since we got a lot of fish, we don’t have a problem reporting what we got. The thing is, when the guy (the dockside inspector) disappears, that’s when we got a chance to make that fish disappear and that fish disappears under a different name. Becomes one of the names where we have a lot of quota, that doesn’t make a difference,” Rafael allegedly said.

”I can call them haddock. This year I’ll have 15 million pounds [of quota] of haddock. So I can call any son of a bitch haddock if the bastards are not there. I rename them. Even when they’re there, I disappear them. I could never catch 15 million. It’s impossible.”

En av de uppköpare som nämns är Michael Perretti, som är verksam på  Fulton Fish Market i New York. Denne är tidigare dömd för fiskhandelsfusk.

Det hela visar hur fel det kan bli när ett system med individuella överförbara fiskerättigheter är felaktigt utformat och utan koncentrationsgränser, när kvoterna på vissa arter inte samverkar med kvoterna på andra arter och det fiskas med icke-selektiva redskap. Det är därför viktigt att system med individuella fiskerättigheter utformas på ett sätt som begränsar hur mycket någon får inneha, att det finns en ordentlig kontroll och redskapsbestämmelser om selektivt fiske.

En dotter till Carlos Rafael, är ansvarig för att hantera fiskerättigheterna i en del av de fiskevatten där Carlos Rafaels fiskeflotta verkar. Ett klart problematiskt förhållande i sig själv. Genom att Carlos Rafael har insyn i hanteringen av fiskerättigheterna, äger såväl fiskbåtar som fiskberedningsindustri så har hans fusk underlättats. Men dålig fiskeriförvaltning utan koncentrationsspärrar, dålig reglering av fisket och dåliga kontrollmekanismer är grundförutsättningarna för att han kunna fuska under så lång tid.

Carlos Rafael är med sina nästan 50 båtar, varav ungefär 10 ägnar sig åt demersalt fiskfiske den klart största innehavaren av både båtar och fiskerättigheter. 12 av hans båtar ägnar sig åt scallopsfiske. Systemet i nordöstra USA bygger på tillstånd, totalt finns det 1 119 tillstånd. 80% av dessa kontrolleras av 121 personer/företag. Huvuddelen av Carlos Rafaels fiskeflotta är verksam i sektor 9 där hans dotter är ansvarig förvaltare:

NOAA Fisheries won’t give out Rafael’s actual landings, citing privacy concerns, but a peek inside his empire gives an idea of his potential impact. Around half of Rafael’s 40 vessels are in Sector 9, which has over 80 active members. The sector is managed by Rafael’s daughter, and is one of the most active, catching nearly double the average catch of groundfish of the other 16 sectors. In 2013, Sector 9 landed 7.96 million pounds of groundfish accounting for nearly 19 percent of total landings for all sectors combined.

But that may not account for all the landings. Rafael allegedly told the undercover agents that he ”paints” or renames species like gray sole as haddock, according to the federal affidavit. In 2014, for instance, his sector had just 108,000 pounds of quota for gray sole, of which members reported catching over 92 percent or 102,000 pounds in 2014.

Sector 9 had over 4.3 million pounds of haddock quota in 2014 and reported landings of a little over half that amount. Rafael, who told agents he had 15 million pounds of quota under his control, had plenty of leeway to disguise other species as haddock.

Det finns fler märkliga saker i fallet med Carlos Rafael. Han tillåts exempelvis fortsätta arbeta i fiskindustrin, i fisket och med fiskhandel. För andra företagare som hamnat i hans situation har det varit betydligt värre:

But allowing accused criminals to carry on with their usual affairs is rare. In an unrelated case, Mark Crumpacker, chief marketing and development officer for beleaguered fast-food chain Chipotle, faces misdemeanor charges for buying cocaine seven different times earlier this year. Even though he has been instrumental in working on the company’s recovery plan, a Chipotle spokesman confirms that Crumpacker was placed on a leave of absence following his arrest.

And in the fishing industry, other veterans who have violated fishing regulations have suffered much worse fates. James Spalt, another New England fish business owner, says he was prevented from working in the industry for 16 years after facing civil charges for violating fishing rules in 1997. During that time, Spalt says he was not allowed to buy boats. “I was punished much more severely in a civil matter and with lasting consequences,” Spalt writes in an email.

För att få bukt med fusket som främst beror på ett dåligt utformat system för förvaltningen införs det för närvarande elektronisk övervakning med kameror ombord. Än så länge dock bara på prov. Har yrkesfiskarna inte ett elektroniskt system måste de ha kontrollanter med ombord som de själva får betala. Det sistnämnda är dock ett system som gjort för korruption och fusk.

Vad det verkar så har dessutom en stor del av den US-amerikanska fiskeflottan inte några elektroniska positionsbesrämningssystem som AIS eller VMS vilket alla större och många mindre båtar sen länge har i Europa.

Yrkesfiskets organisationer vill dock införa lite andra lösningar på problemen:

• Mandating permit banks and quota caps is the very least we can do to make sure more people have the chance to make a fair and honest living under quota management systems.

• Allow fishermen to land discards to be donated to food banks, schools and federal food-service agencies without it counting against their personal quota. You can most accurately (and safely) count fish when they’re all being landed at the dock.

• Reallocate federal funds from on-board monitoring to dockside monitoring and better data collection.

• Make cooperative research mandatory under Magnuson for every federally monitored species that is classified as overfished or undergoing overfishing and ensure that that data is incorporated it into an annual assessment.

Dvs de vill ha koncentrationsbegränsningar, landningskyldighet, hårdare kontroll på land och mindre kontroll ombord (vilket dock ger utrymme för fusk med kvoterna,genom olagliga utkast) och mer forskning. Allt detta är rimliga krav och sådant som redan finns i Europa och de flesta TFC-system (catch-shares, ITQ-system).

Koncentrationen av fiskerättigheter hos Carlos Rafael är något som kritiserats hårt av andra yrkesfiskare i New Bedford liksom av miljöorganisationer som också påpekar att fusket leder till felaktiga beståndsuppskattningar:

”A number of these stocks are heavily regulated for a reason. If there is misrepresenting of the catch, that would cause problems for the assessment and the conditions of the fish stock,” said Chris Legault, a NOAA fishery biologist supervising stock assessments at the Woods Hole science center. ”That would be the most concerning situation.”

”Stock assessments can’t work when the data coming off these trip reports is flawed. For years and years you’re saying the dabs (a species of sole) that you were catching were haddock and the dab stock assessment comes out and it’s going to be wrong and eventually the haddock assessment is going to be wrong,” said Peter Baker, director of the Pew Charitable Trusts ocean program for New England. ”It works best when the stock assessments are as close to actual as possible. All people get hurt when they lie about what they are catching.”

Moore, Resolute, Cowboy, Csm, Huntress I, Drake, Sancor, Corsair, Saga, Eileen Marie, Lady of Fatima, North Queen, Tyler N. Noah, Bulldog och Acores. Många med namn associerade mend Azorerna där Carl Rafael föddes och en del med namn kopplades till hans familj. Båtarna ägs i allmänhet av olika bolag som ägs av Carl Rafael och anhöriga till honom. Dessa bolag har ofta namn kopplade till hans familje såväl som till den båt de äger.

Båtarna flyttas också ofta mellan olika bolag som även byter namn med viss regelbundehet. Det är oftast tecken på att allt inte går rätt till ekonomiskt. Alla bolagen har samma adress som Carlos Seafood.

Jämfört med europeiska fiskebåtar inriktade på samma typer av fiske är de äldre och omoderna.
